Cloud Agreement - finothek GmbH as operator of the website
The term "the Website" refers to all URLs of the microadvisory platform operated by finothek GmbH, with the main domain hallosophia.com and the additional domains goodadvice.rocks, sophia.markets, sophia-advisory.com.
By pressing "Accept", the user unconditionally agrees to this agreement.
Likewise, the use of the services of finothek GmbH, which are offered via the website https://www.hallosophia.com/, constitutes an unrestricted agreement to this declaration.
Preamble
finothek GmbH as the operator of the website only gives data access to explicitly selected users (usually project participants of the microadvisory project) and does not inspect stored documents itself.
finothek GmbH recommends attaching documents as project documents instead of sending them as e-mail attachments. All registered users have agreed to both the Code of Ethics and the Terms and Conditions and have thus committed themselves to confidential treatment.
Use, storage and transfer of data
In order to ensure the function of the platform, it is necessary to store certain data of users and also to make it available to other users.
The data is stored and processed on servers of Amazon Web Services, Inc. or subsidiaries or sister companies. Information on the terms and conditions there can be obtained at https://aws.amazon.com/de/legal/?nc1=f_cc. The regulations of Amazon Web Services, Inc. are also applicable to contractual partners of finothek GmbH, as far as no regulation of the general terms and conditions (https://www.hallosophia.com/agb), the data protection declaration (https://www.hallosophia.com/privacy) or this agreement speaks against it. The project files will be stored in a separate AWS bucket and will only be granted access within the scope of the project by the participating parties via a generated link. The link itself has a limited validity period.

Access to data
As mentioned above, the identification of certain data is indispensable for use. Data is only made known to the corresponding contractual partners. This data is generally stored on a project-related basis and remains visible to the relevant contractual partners until this is explicitly no longer desired. Corresponding contractual partners
Corresponding contractual partners are users with whom a business relationship has been entered into. It is irrelevant whether this business relationship was entered into for a fee or free of charge.
Corresponding contractual partners are also users with whom information is exchanged for the processing of advisory services.
Confidentiality.
The dissemination or making known of data provided by other users within the scope of a service via the services of finothek GmbH is a serious offence and can be directly claimed against the damaging party by the damaged user.
The finothek GmbH reserves the right to initiate the immediate exclusion from all services of the finothek GmbH in case of violations of this secrecy.
finothek GmbH does not assume any liability for violations of this secrecy by users themselves.
The finothek GmbH declares its willingness to cooperate in the investigation of the facts in cases of violations or suspected violations of secrecy.
Final provisions
- This agreement exclusively concerns those users who transmit data to finothek GmbH or receive data from finothek GmbH, if these data are intended for another user or are sent by another user.
- This agreement is valid for users in the sense of VI. a. as a supplement to the existing GTC and the data protection agreement.
- If parts of this agreement are or become invalid, the remaining parts of the agreement remain unaffected.
- Orthographic deficiencies and errors, as well as translation errors, shall only affect the validity of the provisions to the extent that they result in significant differences in content to the orthographically correct wording.
